Overview
Welcome to SandWinders. The terms “we,” “us,” and “our” refer to SandWinders LLC. SandWinders operates this website and online store, including all related information, content, features, tools, products, and services collectively referred to as the “Services.”
Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer and sell our products to you.
These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when using our Services. By visiting our website, placing an order, or otherwise using the Services, you agree to these Terms of Service and our Privacy Policy.
If you do not agree to these Terms, you should not use the Services.
1. Eligibility and Account Information
By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence.
You agree to provide accurate, current, and complete information when placing an order or creating an account. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
You may not transfer, sell, assign, or license your account to another person.
2. Product Information
We make reasonable efforts to accurately describe and display our products, including their features, dimensions, materials, colors, specifications, and intended uses.
However, product colors and appearance may vary slightly because of lighting, photography, screen settings, manufacturing tolerances, and normal production variations.
Product descriptions, specifications, materials, components, packaging, and features may be updated or changed when reasonably necessary to improve performance, quality, safety, availability, or manufacturing.
Any such changes will not materially reduce the product’s intended functionality.
We reserve the right to discontinue products, limit quantities, or restrict sales to particular geographic locations or customers.
3. Product Performance and Intended Use
SandWinders products are designed for recreational transportation of personal items over surfaces including sand, grass, dirt, gravel, and pavement.
Actual performance may vary depending on factors including:
- Load weight and distribution
- Sand depth and moisture
- Terrain conditions
- Inclines and declines
- Tire or wheel condition
- Pulling speed and technique
- Weather and environmental conditions
Descriptions of performance, testing results, demonstrations, photographs, videos, and comparisons are intended to illustrate product capabilities under the conditions shown. They do not guarantee identical results in every environment or circumstance.
4. Safe Use
Customers are responsible for reading and following all instructions, warnings, weight limits, and safety information supplied with the product.
Unless expressly stated otherwise, SandWinders wagons are intended to transport beach equipment, recreational items, groceries, supplies, and similar cargo.
The wagon is not intended:
- To transport children, adults, or animals
- To be ridden in or on
- To be attached to a motor vehicle, bicycle, golf cart, or other powered equipment
- To be used on public roadways
- To be used beyond its stated load capacity
- To be used in a manner inconsistent with the supplied instructions
Customers are responsible for inspecting the wagon before use and discontinuing use if any component appears damaged, loose, excessively worn, or unsafe.
5. Orders
Placing an order constitutes an offer to purchase. We reserve the right to accept, reject, limit, or cancel an order for reasons including:
- Product availability
- Suspected fraud
- Pricing or description errors
- Payment authorization problems
- Shipping restrictions
- Suspected unauthorized resale
- Orders placed in violation of these Terms
An order is accepted when we send an order confirmation and successfully process the applicable payment.
If we cancel an order after payment has been processed, we will refund the amount paid for the canceled portion of the order.
Please review your order carefully before submitting it. Cancellation requests are not guaranteed after an order has entered fulfillment.

6. Preorders
A preorder is an order for a product that is not yet available for immediate shipment.
Estimated production, arrival, and shipping dates are provided in good faith but are not guaranteed. Manufacturing, inspection, customs, ocean freight, port processing, transportation, weather, carrier operations, and other circumstances outside our control may affect availability and delivery.
We will provide reasonable updates when a significant preorder delay becomes known to us.
Unless otherwise stated at the time of purchase, customers may request cancellation of a preorder before it enters fulfillment or ships. Once a preorder has shipped, it is subject to our Return and Refund Policy.
Product images shown during a preorder period may include prototypes, preproduction samples, renderings, or demonstration units. Final production products may contain minor changes that do not materially reduce their intended function or performance.
7. Prices and Payment
Prices, discounts, and promotions may change without notice.
The amount charged will be the price displayed when the order is placed, subject to correction of obvious pricing errors.
Unless expressly stated otherwise, listed prices do not include applicable taxes, shipping charges, duties, customs fees, or import charges.
You represent that:
- Payment information supplied by you is accurate and complete
- You are authorized to use the selected payment method
- Charges incurred through your order will be honored
- You will pay all applicable charges, taxes, and shipping costs
We may correct pricing, calculation, or listing errors and may cancel an affected order. If we cancel an order because of an error, any amount paid for that order will be refunded.
8. Shipping and Delivery
Shipping and delivery dates are estimates and are not guaranteed.
We are not responsible for delays caused by carriers, customs authorities, ports, severe weather, natural disasters, labor disruptions, governmental actions, incorrect customer information, or other circumstances beyond our reasonable control.
Customers are responsible for providing an accurate and complete shipping address. Additional shipping charges resulting from an incorrect or incomplete address may be charged to the customer.
Responsibility for the product passes to the customer upon confirmed delivery, except where the product is damaged, defective, incorrect, or otherwise covered by our Return and Refund Policy or Manufacturer’s Warranty.
Please inspect your shipment promptly after delivery. Shipping damage, missing items, or incorrect products should be reported according to our Return and Refund Policy.
9. Returns and Refunds
We do not accept returns for change of mind, buyer’s remorse, or general dissatisfaction after delivery.
Returns, replacements, repairs, and refunds are available only as described in our Return and Refund Policy, including when an order:
- Arrives damaged during shipping
- Contains a manufacturing defect
- Is incorrect because of an error by SandWinders
Products returned without prior authorization may be refused.

10. Manufacturer’s Warranty
Certain products may be covered by a written Manufacturer’s Warranty.
Warranty coverage, exclusions, duration, claim procedures, and available remedies are governed by the warranty terms published for the product.
Unless prohibited by law, warranty remedies may include repair, replacement of defective components, replacement of the product, or refund, at our reasonable discretion.
Warranty coverage does not extend to damage caused by:
- Misuse or abuse
- Accidents or collisions
- Overloading
- Unauthorized modifications
- Improper assembly
- Failure to follow instructions
- Commercial or rental use unless expressly approved
- Normal wear and tear
- Corrosion or deterioration resulting from improper cleaning or storage
- Use for carrying people or animals
Nothing in these Terms limits rights that cannot lawfully be excluded under applicable law.
Written consumer-product warranties are subject to federal requirements, so the separate warranty should clearly identify its duration, coverage, exclusions, and remedies before you publish it.
11. Intellectual Property
The Services and their contents, including product designs, wheel designs, photographs, videos, illustrations, graphics, text, logos, trademarks, trade names, product names, slogans, layouts, and other materials, are owned by SandWinders LLC or used with permission.
They are protected by applicable patent, copyright, trademark, trade dress, and other intellectual property laws.
Certain SandWinders products and designs may be covered by pending patent applications. “Patent pending” does not mean that a patent has been granted.
You may access and use the Services only for personal, noncommercial purposes.
Without our prior written consent, you may not:
- Copy or reproduce site content
- Republish photographs or videos
- Modify or create derivative works
- Sell or commercially exploit our content
- Use our trademarks, logos, product names, or designs
- Reverse engineer or reproduce our proprietary product designs
- Scrape or systematically extract website content or product data
All rights not expressly granted are reserved.
12. Third-Party Tools and Links
The Services may include tools, applications, embedded content, payment services, social-media features, or links provided by third parties.
We do not control and are not responsible for third-party services, websites, content, policies, security, or practices.
Your use of third-party services is subject to the terms and privacy policies of those third parties.
13. Relationship With Shopify
SandWinders is powered by Shopify, which provides the ecommerce platform used to deliver the Services.
Sales made through this store are transactions directly between you and SandWinders. Shopify is not the seller of SandWinders products and is not responsible for product performance, fulfillment, injury, damage, or loss arising from your purchase or use of our products.
You release Shopify and its affiliates from claims arising directly from transactions between you and SandWinders, to the fullest extent permitted by law.
14. Privacy
Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy, available at:

Shopify also collects and processes certain information necessary to provide and improve its ecommerce platform.
By using the Services, you acknowledge that you have reviewed our Privacy Policy.
15. Reviews, Photographs, and Feedback
If you submit reviews, photographs, videos, comments, suggestions, or other content to SandWinders, you represent that you own the content or have permission to provide it.
You grant SandWinders a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, distribute, and promote that content in connection with our business and marketing.
We are not required to:
- Keep submitted content confidential
- Pay compensation for submitted content
- Publish or retain submitted content
- Respond to submitted content
Submitted content must not be unlawful, misleading, defamatory, obscene, threatening, infringing, fraudulent, or harmful.
You may not submit a review using a false identity or conceal compensation or incentives received in connection with the review.
16. Errors and Inaccuracies
The Services may occasionally contain typographical errors, inaccurate descriptions, incorrect pricing, outdated availability information, shipping estimates, or other mistakes.
We may correct errors, update information, or cancel affected orders at any time.
If we cancel a paid order because of an error, we will refund the amount paid for the canceled order.
17. Prohibited Uses
You may not use the Services:
- For unlawful or fraudulent purposes
- To violate applicable laws or regulations
- To infringe intellectual property rights
- To transmit malware or harmful code
- To obtain unauthorized access to systems or accounts

We may suspend or terminate access to the Services for violation of these Terms, suspected fraud, unlawful activity, abuse, or conduct that threatens SandWinders, Shopify, our customers, or third parties.
Termination does not eliminate payment obligations or other liabilities incurred before termination.
Provisions that logically should survive termination will remain effective, including intellectual property, disclaimers, limitations of liability, indemnification, and governing law.
19. Disclaimer of Warranties
Except for any express written Manufacturer’s Warranty provided with a product, and to the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.
We do not guarantee that the website will always be uninterrupted, secure, current, or error-free.
To the fullest extent permitted by law, we disclaim implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
Some jurisdictions do not permit certain exclusions or limitations of implied warranties. In those jurisdictions, these exclusions apply only to the extent permitted by law.
20. Limitation of Liability
To the fullest extent permitted by law, SandWinders LLC and its owners, officers, employees, contractors, agents, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Services or products.
This includes loss of profits, revenue, savings, data, business opportunity, or replacement costs.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
To the fullest extent permitted by law, our total liability arising from a particular purchase will not exceed the amount you paid to SandWinders for the product giving rise to the claim.
21. Indemnification
You agree to indemnify and hold harmless SandWinders LLC, Shopify, and their respective owners, officers, employees, affiliates, contractors, agents, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from:
- Your violation of these Terms
- Your unlawful use of the Services
- Your infringement of another person’s rights
- Content submitted by you
- Your misuse, modification, overloading, or unsafe operation of a product
This obligation applies only to the extent permitted by law.
22. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed if necessary.
The remaining provisions will continue in effect.
23. Waiver and Entire Agreement
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
These Terms, together with all policies incorporated by reference, constitute the entire agreement between you and SandWinders concerning the Services and supersede prior communications concerning the same subject matter.
24. Assignment
You may not transfer or assign your rights or obligations under these Terms without our written consent.
We may transfer or assign our rights and obligations in connection with a merger, acquisition, sale of assets, restructuring, financing, or similar business transaction.
25. Governing Law
These Terms and any dispute arising from them are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.
Any legal proceeding arising from these Terms or the Services will be brought in a state or federal court having jurisdiction where SandWinders LLC is headquartered, unless applicable law requires otherwise.
26. Changes to These Terms
We may update these Terms to reflect changes to our products, Services, policies, operations, or legal obligations.
The current version will be posted on this page with an updated revision date.
Material changes will take effect as required by applicable law. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
